Changes to NZ Legislation

The Reform Bill has come about as a result of the recommendations from the government taskforce's review of the effectiveness of Health and Safety Employment Act 1992.

The taskforce made a number of recommendations for change. Together with the findings from the Royal commission of Enquiry into the Pike River Coal Mine Tragedy the government has promoted the Health and Safety Reform Bill. This will see some major changes to Health and Safety legislation within New Zealand.

The Health and Safety Reform Bill will become a key piece of legislation for every workplace, with significant penalties, both reputational and financial for non compliance.

Brief Overview:

• Due for release September 2015
• PCBU (Person Conducting Business or Undertaking) = Company officers (directors and senior management)
• One of the principle objectives of the Act is to ensure that the PCBU provides a safe place of work and safe systems of work for employees
• PCBUs will be culpable for outcomes of the safety of employees in a way never seen before.
• Health and Safety at Work Act will see a raft of penalties applied which will represent the seriousness of failing to "take all practicable steps"
• PCBUs must be have knowledge of systems and be able to provide evidence of implementation, and involvement
